SMS Consent Information

SpearWerx LLC — Customer-Service Text Messaging

Effective Date: October 11, 2026

1. Overview

SpearWerx LLC uses a verbal opt-in procedure for its customer-requested SMS messaging program.

This page documents how customers authorize SpearWerx to send text messages related to their orders, shipping information, product inquiries, and customer-support requests.

SMS consent is obtained during customer-initiated telephone calls.

The consent procedure has been tested using our ElevenLabs telephone receptionist. Live SMS sending is pending activation.

2. How Customers Initiate Contact

Customers visit our public website:

swphone

Our customer-service telephone number is publicly displayed:

814-679-5096

Customers initiate telephone calls to SpearWerx for assistance with:

  • Product information.
  • Shopify orders.
  • Shipping and tracking.
  • General customer support.

Customers may request that specific information be sent by SMS.

Providing a telephone number or making a purchase does not constitute permission to receive text messages.

3. Verbal SMS Consent Procedure

Jennifer, the SpearWerx telephone receptionist, is configured to obtain explicit verbal permission before customer-requested SMS messages are authorized.

The customer must affirmatively agree to the messaging disclosure.

Exact Verbal Consent Script

Jennifer asks:

“Before I send that, do you agree to receive customer-service text messages from SpearWerx LLC, including the information you’ve requested? Message frequency varies based on your requests, and message and data rates may apply. You can reply HELP for assistance or STOP to opt out at any time. Our SMS Terms are available at spearwerx.com/sms-terms/, and our Privacy Policy is at spearwerx.com/privacy-policy/. Text messages are optional and aren’t required to make a purchase. Do you agree?”

This is the exact consent script used in the documented ElevenLabs demonstration. Both policy URLs reference the current SpearWerx WordPress pages.

The customer must provide explicit affirmative consent before any SMS message is authorized. The production SMS service remains pending activation, and no live messages are sent during consent demonstrations.

4. Affirmative Consent

After Jennifer presents the disclosure, she waits for an explicit affirmative response.

Acceptable responses include:

  • “Yes.”
  • “Yes, I agree.”
  • “I consent.”
  • “Yes, you can text me.”

Silence, uncertainty, or simply providing a telephone number does not constitute consent.

If a customer declines, SpearWerx does not send the requested SMS and offers an available alternative for receiving the information.

5. Mobile Number Confirmation

After obtaining affirmative consent, Jennifer requests or confirms the destination mobile telephone number.

For US telephone numbers, Jennifer requests the standard 10-digit number and repeats it for confirmation.

Customer consent is specific to the requested information and confirmed destination number.

6. Consent Documentation and Message Authorization

The intended production SMS workflow requires consent to be recorded before a message is sent.

The consent record is intended to include:

  • Confirmed mobile telephone number.
  • Explicit affirmative consent.
  • Consent timestamp.
  • Consent source: customer-initiated telephone call.
  • Purpose of the requested message.

This documentation describes the intended authorization process. The production consent-recording and SMS-sending integrations must be verified before live messaging is enabled.

No live SMS should be sent without the required authorization and an operational messaging service.

7. SMS Consent Demonstration

The verbal consent procedure has been tested using the SpearWerx ElevenLabs telephone receptionist.

During the test, Jennifer presented the complete disclosure and waited for an affirmative response.

The tester replied:

“Yes, I agree.”

Jennifer then acknowledged the response and stated:

“Thank you. That completes the consent demonstration. No text message has been sent because our messaging service isn’t active yet.”

This demonstration verifies the conversational consent procedure. It does not represent an actual customer enrollment or successful SMS delivery.

End-to-End SMS Consent Demonstration

SpearWerx LLC — October 12, 2026

The following screenshots document an internal ElevenLabs text-mode demonstration of Jennifer, the SpearWerx AI receptionist, following the customer SMS consent process.

This test demonstrates the required disclosure, affirmative agreement, destination telephone number confirmation, and consent recording. No SMS message was sent during this demonstration.

Step 1 — SMS Disclosure and Customer Agreement

Jennifer presents the complete consent disclosure, including the messaging purpose, variable frequency, possible message and data rates, HELP/STOP instructions, SMS Terms, Privacy Policy, and optional consent. The participant explicitly agrees.

Step 3 — Consent Successfully Recorded

Consent and Messaging Safeguards

SpearWerx obtains express consent during customer-initiated telephone conversations before sending requested customer-service SMS messages. Jennifer must confirm the destination mobile number before recording consent. Customers who decline SMS consent continue receiving assistance by telephone.

The demonstration above is a simulated test, not evidence of an SMS transmission or proof of live-call performance. Outbound customer SMS remains disabled pending approval of the applicable messaging registration.
